Kim Kardashian’s Skims faces trademark lawsuit over name

Kim Kardashian’s Skims brand is being sued by a small New York designer over the use of the “Fits Everybody” name for one of its best-selling collections.

The lawsuit, obtained by Page Six and filed on March 31 in the Southern District of New York, was brought by entrepreneur Denise Cesare, who claims her brand Fits Everybody To A T has held rights to the name for nearly a decade.

Cesare alleges that Skims proceeded with its “Fits Everybody” collection despite “receiving repeated, unequivocal notice” of her prior trademark rights. The filing also argues that the company targeted “a trademark owned by a small, self-funded woman-owned business” and recognised that “the small business owner would likely lack the resources to fight back.”

Lawyers for the plaintiff further claim that Skims made a “calculated decision” to proceed regardless, “relying on its overwhelming financial resources, celebrity connections, and marketing machine to simply crush” Fits Everybody To A T “out of existence.”

“Defendant believes it could simply outspend, out-market, and outlast any legal challenge from a small business owner,” the documents read.

Cesare is seeking a court order blocking Skims from using the name, along with damages, including profits and legal costs.

The filing also claims the similarity between the names has caused consumer confusion, with the smaller brand becoming “effectively invisible” in search results due to Skims’ market dominance.

Kim Kardashian launched Skims in 2019, which has since grown into a multibillion-dollar global fashion brand.
