According to the Andalusian emergency services, rescuers discovered another body on the morning of January 20 at the site of the accident involving an Iryo train, Caliber.Az reports via the Spanish-language daily newspaper.
Earlier reports had put the number of fatalities at 39, later rising to 40.
A further 39 people were injured in the crash, including 35 adults and four children. All are being treated in hospitals across Andalusia, with 13 adults in intensive care. In addition, 43 passengers remain unaccounted for.
The collision occurred when several carriages of the Iryo train, travelling from Malaga to Madrid with around 300 passengers, derailed and struck an Alvia service coming from Huelva in the opposite direction, which was carrying 184 passengers.
