Trump suggests Biden should be jailed while criticising Arctic Frost election probe

US President Donald Trump appeared to suggest that his predecessor, President Joe Biden, should face imprisonment while criticising the origins of the Biden-era Arctic Frost investigation into him.

Trump, posting on Truth Social on October 30, wrote: “He is a CRIMINAL AND SHOULD BE IN JAIL. A MAJOR LOWLIFE AND FAILURE. An ugly person, both inside and out! I beat him badly, and love watching him squirm now.” 

While he did not explicitly name Biden, the comments were widely interpreted as referring to him, alongside a shared article from Just the News that questioned the initial grounds for the probe.

The Arctic Frost investigation examined efforts by some of Trump’s allies to overturn the 2020 election results by submitting an alternative slate of electors to Congress. Former special counsel Jack Smith later took over the investigation, which formed the basis of a four-count federal indictment charging Trump with attempting to subvert the election.

The case was ultimately dismissed after Trump defeated then-Vice President Kamala Harris in 2024.

A 2022 memo that prompted the probe cited clips from interviews as evidence of Trump’s alleged involvement in a criminal conspiracy to nullify the election results. 

Republicans, including House Judiciary Committee Chairman Jim Jordan, have criticised the investigation, framing it as politically motivated. Jordan told Just the News: “It looks like this was just the same old weaponisation, same old political focus…going after your political enemies.”

Several former prosecutors and FBI agents also questioned the justification for the Arctic Frost probe, noting that historical attempts to submit alternative electors in 1876 and 1960 did not lead to criminal charges.

The investigation reportedly sought information from over 400 Republican-leaning groups and individuals, including at least 160 Republicans close to Trump. Recent disclosures revealed that it targeted telecommunications records of eight sitting GOP senators, capturing metadata rather than the content of calls, according to Senate Judiciary Committee Chairman Chuck Grassley.

Trump also criticised Smith directly, posting on Truth Social: “These thugs should all be investigated and put in prison. A disgrace to humanity. Deranged Jack Smith is a criminal!!!”

Following this, Jordan called for Smith to testify before the House Judiciary Committee. Smith has defended the probe and subsequent prosecutions, arguing that Trump would have faced conviction had he not won the 2024 election.
