US administration appeals to Supreme Court in deportation dispute over third-country removals

28 May 2025 13:58

The Trump administration has submitted an emergency request to the US Supreme Court, seeking to overturn a federal judge’s order that mandates the government provide prior notice and an opportunity for migrants to contest deportations to a so-called third country.

The legal dispute originated from a case in Massachusetts, where a federal judge recently ruled that the administration had violated his previous injunction by attempting to deport eight migrants—each with criminal convictions—to South Sudan, Caliber.Az reports, citing foreign media.

The judge determined that the government's actions failed to comply with the court’s requirements, which include procedural safeguards for individuals facing removal to countries other than their nation of origin.

This case is part of a broader series of judicial challenges to the Trump administration’s stringent immigration policies, which have frequently come under scrutiny in federal courts. Critics argue that enforcement agencies have, in several instances, bypassed or insufficiently observed legal procedures established to protect the rights of migrants and asylum seekers.

At the center of the current dispute is the administration’s practice of deporting individuals to third countries—nations other than the one from which a person originally arrived, or an alternative destination authorized by an immigration judge. The federal court has now raised questions about the legality and constitutionality of such removals without appropriate due process.
