Brussels signals tougher stance on Hungary as €18 billion in funds remain frozen

The European Commission considers it essential to make use of all available legal instruments to address what it views as ongoing violations of human rights and rule-of-law standards in Hungary, according to European Commissioner for Democracy, Justice and Rule of Law Michael McGrath.

Speaking upon arrival at the EU General Affairs Council meeting — where European affairs ministers are holding their eighth round of discussions on the possible suspension of Hungary’s voting rights in the Council — McGrath emphasised the Commission’s readiness to act comprehensively, Caliber.Az reports, citing foreign media.

“The European Commission believes it is necessary to use every legal lever at its disposal to ensure Hungary adheres fully to the principles of the rule of law,” McGrath stated.

He pointed out that the most straightforward legal route against Hungary would be initiating an infringement procedure. Such administrative action could ultimately lead to litigation before the European Court of Justice and the imposition of financial penalties.

As an example, McGrath highlighted that the Commission has already initiated one such procedure against a Hungarian law claimed to protect children, but which, according to critics, has been used as a legal basis to ban various public gatherings.

McGrath acknowledged that “assemblies cannot violate children’s rights,” but signalled the Commission's concern that the child protection legislation is being misused to suppress civil liberties and restrict public expression.

When asked about the potential for Hungary to be stripped of its voting rights under Article 7 of the Treaty on European Union, McGrath explained that while his task is to present the Commission’s legal analysis, any final decision rests with the EU member states. “We’re looking forward to hearing the views of other countries regarding Article 7. My role is to present the Commission’s perspective, but the political choice is up to the member states,” he said.

Additionally, McGrath reminded reporters that the European Commission continues to withhold €18 billion in EU budget funds earmarked for Hungary, citing unresolved breaches of rule-of-law commitments.

“To date, €18 billion remains frozen and unavailable to Hungary due to its violations of the principles of the rule of law,” McGrath confirmed.
